Wills and inheritance in the UAE
Without a will, a non-resident's assets in the UAE are distributed under Sharia rules, and accounts and real estate are frozen pending a court decision. A will registered with DIFC or ADJD removes this uncertainty and lets you dispose of your property according to your wishes.
The situation we see most often: a person has an apartment in Dubai, an account with a local bank, and a family in another country. While they are alive, everything works. After they pass away, relatives have to prove their rights in a foreign jurisdiction, in Arabic, with a frozen account and no access to the home.
A will registered with the DIFC Wills Service is recognised by the courts of Dubai and Ras Al Khaimah and is administered under common law. For business owners we separately structure the transfer of company shares.
